Hammabba Beary KAS, Commissioner Urban Development Authority, Vijayapura as Administrator for a period of six (06) months with a direction to frame the Scheme of Administration on par with Model Scheme of Administration and get approved by the Board within two months and take action to constitutate regular committee as per approved Scheme within the stipulated time. PREAMBLE: The Ande Shah vali Makan (Sunni), Mysuru is a Gazette notified waqf property notified vide Government Gazette bearing No. MWB/19(2) 1965, dated: , and it was managed by a notified Muthawalli. Subsequent to the demise of notified Muthawalli the former Minister for Government of Karnataka was appointed as Muthawalli vide Order No. KTW/154/LSM/78 dated: It was brought to the notice of the Board in its Meeting held on by the Hon'ble Board member that Mr. Taj Mohammed Khan in the capacity of Secretary of RIFAHUL MUSLIMEEN EDUCATION TRUST MYSURU has constructed a Complex comprising of 11 shops in Udayagiri towards the eastern side of Farooquia Girls School, Mysuru, on a private land, out of the loan amount and the said Complex has been named as Ande Shah Vali Complex. But, till today the said Secretary has neither repaid the loan amount including interest nor has registered the Ande Shah Vali Complex under Waqf. After due deliberation it is resolved to take action as per Section 52 of the Waqf Act, by the Chief Executive Officer. The Waqf Officer DWAC Mysuru brought to the notice of the Board that Ande Shah Vali Makan (Sunni) Mysuru is presently managed by the RIFAHUL MUSLIMEEN EDUCATION TRUST MYSURU and Mr. Taj Mohammed Khan is the Secretary of the said Trust. He also brought to the notice that the above said makan has been demolished and the land was acquired by the Revenue Department Mysuru for the construction of a Market Complex by City Corporation Mysuru and have paid Rs. 9,82,637=35 as Compensation amount to the institution. The RIFAHUL MUSLIMEEN EDUCATION TRUST MYSURU by availing the Compensation amount as loan, has constructed a Shopping Complex comprising of eleven (11) Shop on a private land and the Complex has been named as Ande Shah Vali Shopping Complex. The Board vide resolution in subject No. 07(1) has resolved to assume the said Waqf Under the Direct Management of the Board and to appoint Janab Mujibulla Zafari, K.A.S.(Rtd.), Special Officer (Survey) Karnataka State Board of Auqaf Bengaluru as its Administrator for a period of eleven (11) months or till a regular Managing Committee is constituted. PREAMBLE: The Eidgah, Umar Khayam Road, Tilak Nagar, (Anegundi Road, Sy. No. 126, 127 & 128 of Maragowdanahally), Mysuru is a Gazette notified waqf property notified vide 'Government Gazette bearing No. MWB/19(2) 1965, dated: As per Board's letter No. KTW /CMC/26/MYE/80, dated: 14th October 1980 election was held and a Managing Committee was constituted for a period of three (3) years for the Management of Eidgah, Anegundi Road, Mysuru and the same was notified on 11th February Subsequently Board vide Order No. KBW /CMC/83/MYS/ dated: 0l appointed Mr. Muzaffar Assaddi Prof. of Political Science, University of Mysuru as Returning Officer to conduct elections to the said Waqf, but election could not be conducted till date. In view of this there is a vacancy in the office of Muthawalli of Eidgah Umar Khayam Road, Tilak Nagar, (Anegundi Road) Mysuru. Presently the Eidgah is being managed by a Self-styled Committee and the Secretary of the said committee is the Secretary of so called RIFAHUL MUSLIMEEN EDUCATION SOCIETY TRUST MYSURU. The Eidgah Committee Mysuru has accorded permission to Lease a portion of land in Survey No. 127 & 128 of Maragowdanahally Mysuru measuring 600 feet South to North, 110 feet West-East, West of Eidgah Musalla and 60 feet South to North, 300 feet, West to East, South West of Eidgah Musalla to MAJLIS-E-RIFAHUL MUSLIMEEN, MYSURU, which is also a Waqf property for construction of School Building etc., for a period of 99 years on an Annual Ground rent of Rs. 100/- vide O.M. No. MYW/19/STP/73, dated: which is notified in the Government Gazette dated: with an option to Lease to (1) MUSLIM GIRLS ORPHANAGE, MYSURU (WAQF), (2) MUSLIM BOYS ORPHANAGE, MYSURU (WAQF) and (3) RIFAHUL MUSLIMEEN EDUCATION SOCIETY. And as per the said O.M. the Eidgah committee, Mysuru has executed a Deed of Lease on (Unregistered Deed of Lease) with MAJLIS-E-RIFAHUL MUSLIMEEN, MYSURU. And as per the provisions of said O.M. the MAJLIS-E-RIFAHUL MUSLIMEEN, MYSURU, in turn Leased out the entire above said land to RIFAHUL MUSLIMEEN EDUCATION SOCIETY, MYSURU, for a period of 99 years on an Annual rent of Rs. 200/- by way of Un-Registered Deed of Lease dated: The Waqf Officer DWAC Mysuru vide letter dated: reported that the Canara Bank, Tilak Nagar, Branch, Mysuru, has published a possession Notice for immovable property in the Times of India Newspaper on calling upon the management of RIFAHUL MUSLIMEEN EDUCATION TRUST, to pay the outstanding amount of Rupees 10,07,76, (Rupees Ten Crore Seven Lakh Seventy Six thousand Three hundred Forty Five and Ten paisa) and interest at the rate of 17 % to % compounded monthly from within the stipulated period failing which the possession of land and building will be taken over by them i.r.o, of property No. 11 EMT lease hold rights of land & building standing in the name of RIFAHUL MUSLIMEEN EDUCATION TRUST. Board vide letter No. KSBA/MSC/03/MYS/15-16, dated: 14th July 2015 requested the Manager Canara Bank, Tilak Nagar Branch, Mysuru not to deal with the immovable property of Eidgah which is a Waqf property and it cannot be taken over by any person U/s 51((1A) of the provisions of the Waqf Act. 1995, instead can seize the material of the defaulter institution and recover the dues from the concerned and not belonging to the Waqf Institution. The Ministry of Minorities Welfare & Auqaf and Under Secretary to Government of Karnataka vide letter dated & directed the Board to take necessary action in the matter. The first response from the RIFAHUL MUSLIMEEN EDUCATION TRUST to the copy of letter dated of Waqf Officer DWAC Mysuru was received which states that the paper publication was only a notice and not evidence of taking over possession of Waqf property. The Secretary stressed the loan is restructured & likely to be liquidated in due course. Be as it may, he admits the hypothication of Waqf property. This is a clear contravention of the provisions of the Waqf Act.

The said Communication was served to the President / Secretary of Eidgah Committee on In response to the afore said communication the Secretary of Eidgah Committee vide letter dated has finally stated that entire matter has to be re-examined and seeks time to defend in an amicable manner. In the letter the explanation given on the specific issues namely the dissolution of Society & formation of a Trust and in respect of registration of Lease Agreement is in consonance with the provisions of Transfer of Property Act, is not satisfactory and there is a clear evidence before the Board which proves that the management of the Wakf has contravend the provisions of Wakf Act, 1995 as amended by Wakf (Amendment Act, 2013). The matter was placed before the Board in its Meeting held on The Board by its resolution in Subject No. 07(1) resolved to assume the said Waqf under the Direct Management of the Board and to appoint a suitable person as Administrator to manage the day today affairs of the institution. Once again the matter was taken up in the Board meeting held on while confirmation of the proceedings of meeting held on and after due deliberation in the matter, it was unanimously resolved to appoint Janab Mujibulla Zafari, K.A.S.(Rtd.), Special Officer (Survey) Karnataka State Board of Auqaf as its Administrator for a period of eleven (11) months or till a regular Managing Committee is constituted as per approved Scheme of Administration to the Eidgah, Mysuru.
